Booking Agreement
Gotrip Travel Service provides an online ordering platform which brings together quality travel services and products from qualified destination suppliers for you to access and order from.
If you access, subscribe to, or use our products or services on this website or mobile application, you are deemed to have understood and fully agreed to the contents of this service agreement (including any modification Gotrip Travel Service may make to this agreement) and agreed to become a registered user of Gotrip Travel Service (hereinafter referred to as "user") in accordance with the website rules of GotripTravel.com.au. Gotrip Travel Service reserves the right to change these terms and conditions at any time without prior notice. Gotrip Travel Service reserves the right for the interpretation of these terms and conditions.
I. Your Rights:
1. During the tour, the tour guide may recommend optional items at additional expense for the guests. You can decide whether you want to participate in optional items (not including the mandatory self-paid items already stated in the itinerary). The destination supplier cannot force you to participate. 2. You have the right to boycott the tour guide if there is a violation of the terms and conditions. If there is a dispute, please consult with the tour guide first and contact us. We will attempt to coordinate a solution. In order to effectively safeguard your interests, please contact us as soon as possible. Complaints received after the tour with no detailed evidence will be regarded as inadmissible by Gotrip Travel Service.II. Your Responsibilities:
1. You must be an individual 18 years of age or older. If you are under 18, you can use GoTrip Travel Service products under the guidance of your parent or legal guardian. Australian nationals who wish to travel to China by themselves must be under the age of 70 years old. If you are over 70 and wish to travel, you must be accompanied by your immediate family and pay for the related products, services and travel insurance for the duration of your trip.
2. You should ensure that your personal physical conditions are suitable when participating in activities which may involve risk. Risky activities include but are not limited to snorkelling, surfing, rafting and other water activities. High risk activities include horse riding, rock climbing, mountain climbing. You should not participate in such activities if you have a health condition including but not limited to cancer, cardiovascular disseases, hypertension, respiratory diseases, epilepsy, mental illness, diabetes, infectious or chronic conditions, or pregnancy. Before participating in any activities, you should schedule a medical examination to ensure that you understand your health conditions and that you can participate in the travel activities. Gotrip Travel Service will not accept any responsibility for personal accidents or losses resulting from poor health.
3. After your registration is successful, Gotrip Travel Service will provide you with a user account and a temporary password. The user account and password will be kept by you; the actions performed or implemented through your account will be treated as your own actions. You will bear the corresponding responsibility and consequences.
4. Before ordering any product or service of Gotrip Travel Service, you are responsible for reading all information and statements related to the product or service, including but not limited to: product price, itinerary details, place of departure, tour fee details, cancellation of orders and refund policy and other information related to the product or service. Once your order is successful, we will assume that you have read, understood and fully agreed to all information related to the product or service.
5. When you use your account to order, please ensure all contact information are correct and relevant. This includes phone numbers, mobile numbers, email addresses and social media application details. The documents and related information you provide to Gotrip Travel Service must be true and valid. If the contact information is missing, or timely communication cannot be established by Gotrip Travel Service via the provided contact method, the resulting costs or consequences will be your responsibility.
6. People of different nationalities have different immigration rules. We urge you to check with all relevant consulates and embassies prior to travel. Gotrip Travel Service does not retain your personal travel documents and does not accept responsibility for passengers failing to obtain the correct document for entry or passage. You must bear the cost for delays and cancellation resulting from a failure to obtain the correct travel documents.
7. You should strictly abide by laws and regulations issued by the government of destination countries, including immigration and customs laws and regulations. Gotrip Travel Service is not responsible for any penalties or penalties incurred by those due to violation of national government regulations.
8. During local travel activities, you should respect the local religious beliefs and ethnic customs, this also applies to the local natural environment.
9. You should confirm your travel activities with the destination supplier a day prior to your trip. This is recommended to avoid any last-minute changes by the destination supplier especially for weekends and public holidays. If you do not make a second confirmation, you may not be able to travel normally and you will be responsible for all direct and indirect losses caused by this.
III. The rights and responsibilities of Gotrip Travel Service
1. Protecting the privacy rights of users according to law is a basic policy of Gotrip Travel Service. Gotrip Travel Service is the sole owner of the information collected by the website. We do not sell, share or lease information to any groups. Gotrip Travel Service collects user information from different sites in order to process orders and optimise services. The information use of Gotrip Travel Service will be described in detail in the Privacy and Terms policy. The privacy and security policies of Gotrip Travel Service are part of this agreement, and you agree to grant us the right to use the data mentioned, not as an infringement of your privacy rights.
2. The user clearly understands and agrees that the products and services information of Gotrip Travel Service may change at any time and Gotrip Travel Service will not make any special announcement about this. Every endeavour has been made by Gotrip Travel Service to ensure that the product and services information to which these terms and conditions relate is accurate at the time of publishing. Gotrip Travel Service shall not be liable for any injury, damage or loss caused by any inaccuracy or misdescription contained.
3. To protect the common interests of you and Gotrip Travel Service, if you have any issues which may obstruct or hinder the normal operation of the tour group, Gotrip Travel Service and destination product suppliers have the right to cancel your eligibility to continue participating in the itinerary. This decision is final and in such an event a passenger cannot ask for a refund or transfer.
4. If you do not arrive at the pick-up point at the scheduled time, you may miss the opportunity to board the car and you cannot join the group. In this case, Gotrip Travel Service will not be liable and will not refund the tour expenses.
5. If for your personal reasons, you are to make your own way to the intended destination, Gotrip Travel Service will do its best to assist you in your arrangement but will not be responsible for any loss that you may incur.
6. Gotrip Travel Service is not responsible for any costs (or increased costs) or damages caused by your dispute with suppliers or third parties. You must not defame Gotrip Travel Service or its affiliates; otherwise, Gotrip Travel Service or its affiliates reserves the right to pursue your legal responsibility for such incidents.
7. The product offerings available are all provided by qualified travel and tourism companies that have been selected through Gotrip Travel Service strict evaluation. Gotrip Travel Service is only responsible for the description and commitment of the itinerary and may not be involved in any inconveniences caused by personnel service or force majeure events. Gotrip Travel Service makes no representation or warranty with the respect to the standard of service given or provided by any suppliers, you hereby acknowledge that in entering into this agreement, there has been no reliance upon any such representation or warranty by or on behalf of Gotrip Travel Service. Gotrip Travel Service shall not be liable or responsible to any person in the event of dissatisfaction with such service or accommodation or be liable or responsible for any disappointment, distress, vexation or loss of enjoyment arising from any act or omission whatsoever.
8. The electronic ticket voucher is an attachment to the contract and has the same effect as this contract.
IV. Ordering and Payment Process:
1. After you submit your booking and payment, you will receive a booking receipt via E-Mail. To ensure faster processing, you can also inform our online customer service at: info@gotriptravel.com.au for booking confirmation and we will immediately check the receipt of your payment.
2. After you have successfully paid for the booking, we will start the ordering process for you. The order confirmation time is generally 1~5 working days. Once the order is confirmed, you will receive an electronic ticket of the itinerary in your registered email. In the electronic ticket, we will provide all details of the corresponding travel product to facilitate your reconfirmation.
3. The electronic ticket is your proof of purchase. You only need to print out the electronic ticket and bring a valid photo ID to the corresponding travel product supplier. Please note that the electronic version of the group ticket is the only proof of your purchase and group participation (the reservation receipt or other notification email is invalid).
4. You can contact the local tour provider before departure to reconfirm your arrival.
V. Change and Cancellation Policy:
Details of the amendments and cancellations of Gotrip Travel Service’s products and services can be found in the Change and Cancellation policy. This policy constitutes an integral part of this agreement and has the same effect as this agreement. Based on the needs of business operations, Gotrip Travel Service reserves the right to revise this policy from time to time.
VI. Price and Exchange Rate:
Gotrip Travel Service’s prices for all travel products are calculated in Australian Dollars at different times. For example, prices may increase on weekends and public holidays. Please check the final confirmation. The exchange rate is exchanged in real time using the latest exchange rate of UnionPay. The exchange rate will change from time to time. Orders placed at different time periods may not be the same. If the above situation occurs, the difference will not be refunded.
VII. Chargeback
When purchasing a product or service from Gotrip Travel Service, an electronic ticket is provided as proof of purchase. Electronic tickets will be delivered by means of email or fax, it will not be mailed. If either proof of delivery of the electronic ticket can be provided by Gotrip Travel Service via time-stamped computer records or proof of fax transfer, you agree not to initiate a payment dispute via a credit card chargeback (Discover, MasterCard, VISA, American Express or the bank which issued the credit card). If you do initiate a chargeback, you must provide a handwritten certificate to the credit card company, along with a statement of your justification and fax a copy of this statement to Gotrip Travel Service, fax number 61-2-92115757. If the chargeback is deemed improper by Gotrip Travel Service, Gotrip Travel Service will take legal action to retrieve the funds and if the lawsuit is successful, you will also be responsible for all costs arising from the lawsuits and attorney’s fees.
VIII. Travel Insurance:
In order to ensure that your rights are protected during the trip, Gotrip Travel Service strongly recommends that you purchase comprehensive insurance to cover medical costs, baggage loss, travel cancellations, and flight delays. Gotrip Travel Service does not accept any responsibility for accidents during your trip, including flight cancellations, delays, lost or damaged items, personal physical or loss of life. In resolving such issues, we will follow the policies of the specific companies involved.
IX. Legal statement
This "User Services Agreement" is regarded as an agreement between you and Gotrip Travel Service. This agreement complies with the relevant laws of the State of New South Wales, Australia and is consistent with its legal provisions. Once you use Gotrip Travel Service and enjoy the services provided, it is deemed that you have agreed to unconditionally comply with all legal provisions. If for any reason, any part of this agreement is totally or partially invalid, the remaining provisions of this document remain valid and binding. If Gotrip Travel Service does not exercise or enforce its rights under this agreement, this does not constitute a waiver of those rights. This agreement cannot be used as a proof and basis for the partnership, cooperation, appointment, or joint venture between Gotrip Travel Service and product suppliers or any other company groups. Product suppliers and any other company groups do not have the right to exercise any duties and responsibilities in the name of Gotrip Travel Service.
